I'm setting my up my Mac Mini to work with the new HDTV. DVI->HDMI
cable in, with sound routed directly to amp. Very nice display, except
that the machine always reboots into overscan mode. I don't want that -
it pushes the menu bar off the top of the screen and puts the dock
slightly off-screen too.

I can disable it fine, and the display then appears as I'd like it. But
next reboot and overscan is magically back - how can I prevent this?

I don't know, but my own Mini with DVI->HDMI doesn't do that. It stays
in the state I leave it.

(It also leaves a big black border (no overscan) or leaks off the
screen (overscan) when I set it to 1080HD res or most other modes, so
I've got it on 1360x768 which matches the TV screen edges perfectly
and also fits the EyeTV stuff to the screen at a readable size from
the couch)

Maybe trash your prefs? I think it's in systempreferences
unfortunately...
