If your license server is having Windows Server 2008 TS CALs and Windows Server 2003 TS tries to get a CAL then license server will issue Windows Server 2008 TS CAL to it. But the condition for this is that you shouldn't set 'Prevent Upgrade Group Policy' on the license server.
