If it can backfeed to the utility under any possible circumstances, let alone is known to do so, it is dangerous and illegal for the purpose intended. Moreover, if it is known to backfeed the utility line under some known circumstance, is constitutes a murderous device; guaranteeing that you go to jail if anyone gets hurt because you connected it to the grid.
