every doc i scan comes up in xml. but when i scan mil forms it will only scan
as a photo.

What is a mil form ?
What type of photo file ?

Is this a Word related problem? What version of Word and OS and are they
patched up to date. What are you scanning with? Have you got an OCR utility?
