Or is > it more random than that? I've found if I insert them into my Magic Mouse after a fresh charge, Mac OS X reports the mouse somewhere between 50-60% charge. It also seemed like the OS reported it empty faster than with normal batteries. I guess that is because NiMH cells have a lower nominal voltage than alkalines. Maybe you get used to this? I just got one a few weeks ago. I generally like it, but I have the opposite problem to yours. Frequently when I just intend to move the mouse it also detects a swipe on the surface, so whatever window I'm moving over scrolls unexpectedly. My guess is that my palm is resting on the surface and shifting as I move.
