SAN FRANCISCO (KCBS) -- The federal program is called Secure Communities and it allows for the state justice department to automatically forward the fingerprints of all suspects to Immigration officials for a status check. That runs smack into San Francisco's policy of only reporting felony suspects who's status can't be verified. Sheriff Mike Hennessey says soon misdemeanor suspects will be reported to Immigration and Customs Enforcement as well. KCBS' Holly Quan reports "Everyone booked in the jail will be reported to ICE, starting in June," he said. While this policy has some city leaders worried about an end run around the sanctuary status, San Francisco's Mayor says the policy was never designed to protect criminal behavior. Federal officials say from October to March, nearly two million fingerprints were submitted for a cross check resulting in 212 thousand matches and 56 thousand immigration arrests or holds, many of those detainees are expected to be deported. http://www.americanpatrol.com/REFERENCE/PENALCODE/834b-CA_PC.html Voter approved California law aimed at dealing with illegal aliens Calif. (a) Every law enforcement agency in California shall fully cooperate with the United States Immigration and Naturalization Service regarding any person who is arrested if he or she is suspected of being present in the United States in violation of federal immigration laws. (b) With respect to any such person who is arrested, and suspected of being present in the United States in violation of federal immigration laws, every law enforcement agency shall do the following: (1) Attempt to verify the legal status of such person as a citizen of the United States, an alien lawfully admitted as a permanent resident, an alien lawfully admitted for a temporary period of time or as an alien who is present in the United States in violation of immigration laws. The verification process may include, but shall not be limited to, questioning the person regarding his or her date and place of birth, and entry into the United States, and demanding documentation to indicate his or her legal status. (2) Notify the person of his or her apparent status as an alien who is present in the United States in violation of federal immigration laws and inform him or her that, apart from any criminal justice proceedings, he or she must either obtain legal status or leave the United States. (3) Notify the Attorney General of California and the United States Immigration and Naturalization Service of the apparent illegal status and provide any additional information that may be requested by any other public entity. (c) Any legislative, administrative, or other action by a city, county, or other legally authorized local governmental entity with jurisdictional boundaries, or by a law enforcement agency, to prevent or limit the cooperation required by subdivision (a) is expressly prohibited.

(2) _Read_ the law, it requires an unlawful act BEFORE interdiction. (3) "Profiling" in traffic is impossible. Try it sometime. (4) Presentation of a valid Driver's license (*) disallows questioning about immigration status. (*) AZ uses hologram technology, and the police carry a tool to verify that it's not forged. (5) If ICE doesn't cooperate, we'll create another law, try 'em, then hand 'em off to Arpaio for a year. They'll not come back. (6) Illegal population is already down _significantly_ and the law hasn't even gone into effect yet... they're fleeing north to avoid Arizona's law. I personally know people that say their yard workers have fled. (My yard guy is a smart middle-aged white guy with several secretarial service and publication corporations... but likes to work outdoors :-) (7) Worst comes to worst, we'll bus 'em north.
