Yes. I have never registered for an iTunes Store account, nor a .Mac account; if I click on the shopping cart in iTunes, I'm prompted to create an account. I have successfully subscribed to and downloaded free podcasts in iTunes. I'm listening to one right now.

If you want the free content then you have to have an iTunes account. This is because the free content is free TO YOU, and not free for your to distribute, so it has the DRM/Fairplay on it.

Some free content requires an account, some doesn't. I've downloaded a few podcasts and videos without an account, but there are other free items that it won't let me have unless I get an account.

Yes, I don't have an iTunes account and am subscribed to several free podcasts. In the case of many podcasts, the podcaster hosts their podcast feed on a server they provision. The iTunes store functions as a directory. Once you subscribe, your iTunes client takes care of tracking new episodes and downloading them from the podcaster's hosting.
