Why do the namby pambies, the ones that defend the nanny state, the ones that do not see the large and cumulative effects of court decisions like this on society, the ones that cannot see the forest for the trees, the ones that have not a single inkling of the domino effects of constant and tiresome pleadings for damages for the result of actions that could be avoided had the claimant been more reasonably careful or simply more lucky, the ones who cannot connect up issues in one microscopic case with issues in many other cases, the ones that seem never to understand basic principles, always seem to be closing this case? what are they so frightened of? -- dorayme

I had a rather nasty accident slipping in a public bathing area once and it was a big bother getting over it, there was a slippery surface. The council could have done something about this considering the vast sums they otherwise wasted on more frivolous things. However I believe they should be held *less responsible* for the things that *more care* by citizens would avoid. I was not particularly careless. There were some odd circumstances to do with unusual low tide, exposed slippery rock slabs... I was just standing still, amazingly, prior to entering the sea. But a slight correction in my balance and... well I won't bore you with the details much fond as I am with issues concerning myself... <g> -- dorayme

Case closed. > You sprinkle your posts with unsubstantiated claims, and respond with sarcastic remarks when someone takes issue? How about offering some substantiation of your blanket claims regarding the correct temperature of coffee, or that manufacturers of sharp knives are immune to prosecution for damage due to careless handling of their products, or that spilling coffee and cutting oneself are not analogous? Making unsubstantiated authoritative claims -- as if they were well-established immutable laws of nature -- certainly doesn't constitute a demonstration of the "intellectual power of your argument." -- iMac (24", 2.8 GHz Intel Core 2 Duo, 2GB RAM, 320 GB HDD) OS X (10.5.8) |
