Those are two different things. It is not proprietary, it is an
international standard (ITU H series). It also requires licensing
because it depends on patented technology.

I'm not sure what happens if you develop an H.264 implementation in a
country that doesn't agree that the technology is patentable.

It is also unencumbered by video quality given similar bit rates to H.264 :-)

Exactly. The Fluendo folks make a living selling codecs for
patent-encumbered algorithms (eg MP3, WMV) for Linux and OpenSolaris,
so even those folks get to play.

And, moving away from the desktop, it's also unencumbered by hardware
decoders (so not much use for iPods and the like).

Which is a major problem.

The last problem sounds a bit FUDish, but it is suspected that Theora
*might* infringe on patents and the only reason they haven't been
"done" is that they're just too small to be on the legal radar.

Apple won't allow any non-Apple API with that much power on the iPhone
for reasons of fascist control and Stalinist security (hey, if there's
no oppressed , so that's not an immediate worry.
